Donna teacher faces more charges

DONNA - A school teacher suspected of distributing "harmful material" to minors was in court again Tuesday on new charges, officials said.

Adolfo Davila De Leon, a former Donna Veterans Middle School biology teacher, was arraigned in municipal court on one count of distributing harmful material to a minor, a misdemeanor charge that carries a sentence of up to one year imprisonment and up to a $4,000 fine if convicted.

This is the third time the 36-year-old De Leon, who was recently fired from the school district, has faced similar charges. On April 24, De Leon was arraigned on two counts of distributing harmful material to minors.

Details of the incidents that led to the charges remain murky. School officials are mute and have refused to disclose any details of the incidents.

"As far as the district is concerned the investigation revealed he was showing harmful material to minors," said Roberto Loredo, Donna Independent School District Superintendent. "So we made the decision to terminate."

Loredo and Donna school district police have so far refused to release the probable cause affidavit for De Leon's prior arrest, citing an ongoing investigation. They have challenged a Monitor records request with the Texas Attorney General's office.

De Leon, who turned himself into police Tuesday to face the charges, was released after the arraignment on a $2,000 personal recognizance bond. He had previously posted a $20,000 bond after his first arrest on the charges.

A spokesperson for the Texas Education Agency, said Tuesday that the agency, which regulates teaching licenses, is investigating the charges against De Leon.
